Act 114 of 2006 (House Bill 185)
Makes omnibus changes to the school code, including outlining
procedures school boards must follow prior to entering into a
contract for food sold in competition to a school's cafeteria
(such as contracts with soda vendors).
HOUSE BILLS
House Bill 143 (Rep. Timothy Solobay)
Requires criminal background checks for current and
prospective school directors and prohibits individuals who
have been convicted of certain crimes within the past five
years from serving as a school director.
House Bill 186 (Rep. Jess Stairs)
Requires school boards to publicly report the amount and
sources of funds received and expenditures made from funds
received from competitive food and beverage contracts.
House Bill 380 (Rep. Robert Godshall)
Requires collective bargaining agreements to be made publicly
available at least 10 days before ratification and requires
school boards to provide "a reasonable opportunity" for public
comment prior to ratification.
House Bill 383 (Rep. Robert Godshall)
Prohibits school districts from beginning the school year
for students before labor day.
House Bill 384 (Rep. Robert Godshall)
Requires school district to allow home education students to
participate in extracurricular activities.
House Bill 442 (Rep. Stephen Cappelli)
Requires school boards to develop policies for testing a
school's physical facilities for the residue of illegal drugs.
Also, requires boards to develop policies that prohibit
students from attending school-sponsored events under the
influence of drugs or alcohol and to provide for drug and
alcohol abuse prevention and awareness as part of the health
curriculum.
House Bill 593 (Rep. Dante Santoni)
Removes constables from the list of individuals who are not
eligible to serve as school directors.
House Bill 1404 (Rep. Curt Schroder)
Makes school district superintendents and assistant
superintendents "at-will" employees of the school board and
allows school boards to fire these administrators with or
without cause.
House Bill 1722 (Rep. Victor Lescovitz)
Reorganizes the state's 501 school districts into county-wide
or regional school districts.
House Bill 1914 (Rep. Curt Schroder)
Allows school boards to remove the district superintendent,
assistant superintendent, and any of its officers, employees
or appointees with or without cause and without holding a
hearing. Current employees would be allowed to complete the
remainder of any contract they hold with the district and
would become at-will employees in the first contract renewal
following the effective date of HB 1914.
SENATE BILLS
Senate Bill 144 (Sen. James Rhoades)
Changes the term of service for school directors from four to six years.
Senate Bill 298 (Sen. James Rhoades)
Requires school directors elected in November 2005 and
thereafter to complete a training course and pass an
examination within nine months after election to office. The
state Department of Education would develop the required
training, administer the course, and conduct the assessment.
School directors who fail to earn certification by passing the
course must resign from office or their school district will
be financially penalized.
Senate Bill 642 (Sen. Gibson Armstrong)
Allows school districts to purchase land or buildings from a
member of the school board as long as the transaction in made
in compliance with state ethics and financial disclosure laws
and the proposal is approved by the county court of common
pleas. The school board must petition the court for approval
and submit affidavits from two independent real estate
appraisers certifying that the purchase price is fair and
reasonable.
Senate Bill 689 (Sen. Don White)
Requires that in school districts situated in two counties at
least one school board member be from the county with smaller
geographical portion in the district. If a district is not in
compliance with this provision it must select by lot a vacancy
to be filled prior to the date of filing nominating petitions
for the next school board election.
